Payment in Installments with Affirm

1. Overview of Affirm’s Service

Affirm is a deferred payment or installment loan service provided by Affirm Holdings, Inc. ("Affirm"), a U.S.-based financing company regulated under American laws. This service allows Vanpackers’ customers to pay for their purchases in multiple monthly installments, subject to Affirm’s approval.

Affirm is not a Quebec financial institution: it is an independent credit provider governed by U.S. laws. The financing terms (interest rates, repayment period, installment amounts) are determined solely by Affirm, not by Vanpackers. We are not responsible for Affirm’s credit approval decisions, repayment terms, or any disputes arising from the financing agreement.

2. Eligibility Requirements

To use Affirm’s installment payment service, customers must:

  • Be at least 18 years old (the age of majority in Quebec).
  • Reside in Canada or in the USA (or a province where Affirm operates).
  • Have a valid Affirm account and a registered payment card (debit or credit).
  • Have their credit application approved by Affirm after a solvency check (credit verification under Canadian laws).

Exclusions:

  • Business-to-business (B2B) transactions.
  • Products or services excluded from financing by Affirm (e.g., gift cards, subscriptions).

3. How Installment Payments Work

  • Payment Method Selection: The customer chooses "Affirm" as their payment method during checkout on Vanpackers’ website.
  • Financing Application: The customer is redirected to Affirm’s platform to complete their application. Affirm conducts a credit check (in compliance with Canadian laws) and provides an instant decision.
  • Approval of Financing: If approved, Affirm pays the full purchase amount to Vanpackers upfront. The customer then agrees to repay Affirm according to the terms of their credit agreement (interest rate, duration, installments).
  • Denial of Financing: If denied, the customer must select an alternative payment method to complete their order. Vanpackers is not informed of the reason for denial.

4. Customer Obligations

By selecting Affirm as a payment method, the customer:

  • Accepts Affirm’s Terms and Conditions (available here), which prevail over these terms in case of conflict.
  • Agrees to repay Affirm according to the agreed-upon schedule, including interest (if the financing is not 0% APR).
  • Acknowledges that failure to make payments may result in:
    • Late fees (as per Affirm’s terms).
    • Negative impact on their credit score.
    • Legal action by Affirm (in accordance with U.S. laws).
  • Authorizes Affirm to automatically debit their registered payment card for installments.

5. Vanpackers’ Responsibilities

  • Vanpackers acts as an intermediary between the customer and Affirm. We are not a party to the credit agreement and cannot modify its terms.
  • We commit to:
    • Transmitting the necessary information to Affirm for order processing (amount, product description, etc.).
    • Complying with Quebec’s Consumer Protection Act (CPA) and other applicable Canadian laws.
  • We are not responsible for:
    • Affirm’s approval or denial of financing.
    • Fees, interest, or penalties charged by Affirm.
    • Disputes between the customer and Affirm regarding repayment.
    • Consequences to the customer’s credit report in case of default.

6. Right of Withdrawal and Refunds

6.1 Right of Withdrawal (CPA, Sections 54–64)

Customers have a 10-day cooling-off period to cancel their purchase (from the date of receipt for goods or the conclusion of the contract for services). In case of withdrawal:

1. The customer must return the product in its original condition, at their own expense, by contacting Vanpackers’ customer service.

2. The customer must contact Affirm to cancel their financing or adjust their repayment schedule:

3. Vanpackers will refund Affirm, who will then credit the customer’s account. The customer remains responsible for any installments already debited by Affirm until the balance is settled.

6.2 Refunds for Returns or Cancellations

  • If a product is returned or canceled, Vanpackers will refund Affirm, who will adjust the customer’s balance.
  • The customer must follow Affirm’s instructions to modify their repayment schedule.

7. Disputes and Complaints

7.1 Complaints Related to Affirm

For issues regarding Affirm’s service (denied financing, debits, fees), customers must contact Affirm directly:

7.3 Recourse in Case of Dispute

If a dispute persists, customers may:

  • Contact the Office de la protection du consommateur (OPC) du Québec:
  • Seek mediation or pursue legal action (in accordance with applicable laws).

8. Protection of Personal Information

  • The customer’s personal information (name, address, payment details) is shared with Affirm to process the financing application. Affirm is responsible for processing this data in accordance with its Privacy Policy and Canadian laws (PIPEDA, Quebec’s Law 25).
  • Vanpackers does not retain any banking information related to this service.

9. Modifications to the Service

Vanpackers reserves the right to:

  • Suspend or modify its partnership with Affirm at any time, without prior notice.
  • Update these terms, provided customers are informed via our website or email.

10. Applicable Laws and Jurisdiction

  • These terms are governed by the laws of Quebec and applicable Canadian federal laws.
  • Any disputes regarding the interpretation or execution of these terms will be subject to the courts of Quebec, without prejudice to the consumer rights under the Consumer Protection Act (CPA).
